Is it worth patenting inventions? - Briefly about the patent procedure
Few people and institutions patent inventions. You've probably wondered more than once what a patent gives you? It allows its inventor a time-limited monopoly on the commercial exploitation of his idea. This allows you to start producing and selling your product without fear that it will also be produced and sold by competitors, which will have a significant impact on the price of the product.
However, not everything is worth patenting. Technology is progressing faster and faster, and inventions are becoming more obsolete than they used to be. So is it worth applying for patents? When can we apply for a patent?
Patent procedure - How to patent inventions?
In Poland, patents are issued for 20 years. They can be obtained by meeting three conditions:
(1) The invention must be new and not part of the state of the art.
(2) It must possess an inventive step and, therefore, cannot be clearly deduced from the state of the art for an expert in the field of specialisation,
3. it must be suitable for industrial application - with its use a product or method of production may be used, in any industrial activity (not excluding agriculture).
In order to start a patent procedure, an invention must be filed with the patent office, revealing a detailed way of reproducing it, so that an expert in the field can easily reproduce the invention without unnecessary and knowledge of additional procedures. This involves the complete disclosure of the invention. It is then evaluated in terms of relevance, innovation and industrial application.
